8. How do you handle dual agency or conflicts? Members of the Core Team and all Market Champions are exclusively tenant representation brokers and are experts within the legal sector and will solely represent NMRS’ interests in all scenarios evaluated in this assignment. At C&W, we have a fiduciary responsibility that we take very seriously and are able to ensure that our clients will receive objective representation by establishing a transparent process with clear goals and objectives. C&W is also not a developer, owner, or investor of real estate. C&W maintains a company-wide policy that requires strict adherence to confidentiality of all information provided by our clients. Similar to how a law firm must assess whether or not it can advise a client without conflict, so must C&W when determining whether or not a particular assignment potentially conflicts with its own interests. C&W takes this evaluation very seriously and the Core Team follows the company’s policy of transparency and disclosure of all possible conflicts to our clients. There may be times when C&W will be on both sides of a transaction, and this will be fully disclosed to NMRS. In addition, C&W—and in many cases state law—requires that we enact certain safeguards and firewalls to ensure that the integrity of dual representation engagements are handled at arm’s length and our respective clients’ best interests are kept at the forefront. Such safeguards prohibit the sharing of client information and making full disclosure regarding our duties to the parties. This way, C&W is in no way obligated to appease any landlord and is compensated the same in each building NMRS may consider. C&W abides by the strictest of ethical codes and would tolerate nothing less out of any individual without swift and decisive action.

All C&W transactions—both large and small, in major global metropolitans or remote locations—follow the same, proven process and standards, which are then customized to NMRS’ specific preferences and requirements. The Core Team will oversee all transactions and ensure every transaction is properly sourced and follows the processes implemented for the NMRS account—and in full alignment with NMRS’ overall real estate strategy. They will collaborate with the Market Champions to ensure consistent, high-quality service is delivered across all assignments in all markets portfolio-wide, regardless of project size, type, or location. Smaller and remote transactions will always be pursued with the same diligence that is typically provided on larger transactions. 7. Does your firm also provide landlord services/asset leasing? C&W provides a broad platform of services that bring great add value to our clients, including landlord representation by advisors who specialize in the leasing of office buildings. This expert knowledge that C&W possesses will provide NMRS with a complete view of each market in which the Firm is located, including every tenant, landlord, new development, vacant space, and off-market “shadow space.” In addition, in the event that either through acquisition or strategic planning, NMRS requires agency subleasing/disposition services, the Agency teams are available to augment our platform of services provided to the Firm.
